OFFICIAL RULES OF SWEEPSTAKES
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL APPLICABLE GOVERNMENT LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
- Eligibility
This sweepstakes (“Sweepstakes”) is only open to those individuals who (a) are of legal drinking age according to the jurisdiction where they are located, and (b) are located in the 50 states of the United States of America. Employees of Sponsor (hereafter defined) or its affiliates and other companies associated with the promotion of the Sweepstakes, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Sweepstakes are subject to all applicable government laws and regulations.
- Sponsor
The Sweepstakes are sponsored by Sovereign Brands, L.L.C. (“Sponsor”), with an address at 383 W. Broadway, 5th floor, New York, NY 10012.
- Agreement to Official Rules
Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. This promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. Entrant’s information is being provided to Sponsor and not to Instagram.
By submitting a photo, comment, or a “like”, in connection with the Sweepstakes, entrant grants Sponsor and its affiliates an irrevocable, perpetual and royalty-free right to use, reproduce, edit, display, transmit, modify, publish, and otherwise make use of the submitted photo or other information in any and all media, whether now known or hereinafter created for any purpose. By submitting any photo, you hereby represent and warrant that the submitted photo or information does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and entrant has the right to grant any and all rights and licenses granted to Sponsor herein, including but not limited to all necessary rights under copyright laws.
- Sweepstakes Period
The Sweepstakes begin upon the posting of the initial announcement of the Sweepstakes on Instagram by the Sponsor (with the initial date Sweepstakes set forth in such posting) (the “Sweepstakes Posting”) and ends at 11:59 p.m. ET of the seventh (7th) day following the day of the posting of the Sweepstakes (the “Sweepstakes Period“). Entries that are submitted before or after the Sweepstakes Period will be disqualified. Submissions will be accepted for the duration of the Sweepstakes. Sponsor’s clock is the official timekeeping device for the Sweepstakes and Sponsor’s decision, in its sole discretion, concerning any submission issues are final and binding.
- How to Enter
One (1) Sweepstakes will be conducted, with the number of winner(s) as are specified in the Sweepstakes Posting. To enter, see rules stated in the Sweepstakes Posting. Limit one (1) entry per person, per email address, per household and per the Instagram account for the duration of the Sweepstakes Period, regardless of method of entry. Entries received from any person, email address, Instagram account, or household in excess of the stated limitation will be void. Any attempt by any entrant to obtain more than the stated number of entries by using multiple or different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. All entries become the property of Sponsor and will not be acknowledged or returned. Sponsor shall resolve any and all disputes or issues concerning whether the permitted number of entrant(s) has been exceeded and which of such entrant(s) will be accepted, and Sponsor’s decision, in its sole discretion, concerning same shall be final and binding.
- Prize Drawings
Within approximately two weeks following the Sweepstakes Period, Sponsor will (a) select potential winners in a random drawing from among all eligible entries received, and (b) attempt to notify the potential winner(s) via Instagram. The odds of being selected depend on the number of entries received. If the potential winner cannot be contacted within seven (7) days after the date of the first attempt to contact him/her, (a) the Sponsor’s decision, in its sole discretion, concerning whether a response is received timely shall be final and binding, and (b) and if no response is received, the Sponsor may, in its sole discretion, decide whether or not to select an alternate potential winner in his/her place at random from the remaining non-winning, eligible entries.
- Winner Notification
The potential winner(s) will be notified by message on Instagram. Each potential Prize winner may be required to complete, electronically sign and submit a Declaration of Compliance with these Official Rules within three (3) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period (if applicable), or prize is returned as undeliverable, the potential winner(s) forfeits the prize. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, in Sponsor’s sole discretion, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Whether Sponsor conducts an alternate drawing(s) is within the Sponsor’s sole discretion, and if no further alternate drawing is conducted, the prize(s) will remain un-awarded.
- Prizes
The prize or prizes for the Sweepstakes are identified in the Sweepstakes Posting and the ARV of such prizes are as follows:
If Sweepstakes Posting prize is a T-shirt, ARV = $30
If Sweepstakes Posting prize is a Baseball Cap, ARV = $20
If Sweepstakes Posting prize is a Sweatshirt, ARV = $50
If Sweepstakes Posting prize is a Jacket, ARV = $150
If Sweepstakes Posting prize is a Bar Kit, ARV = $75
If Sweepstakes Posting prize is Glassware, ARV = $10 per glass
If Sweepstakes Posting prize is an Autographed Apparel, ARV = $250
If Sweepstakes Posting prize is a robe, ARV = $70
- General Conditions
In the event that the operation, security, or administration of the Sweepstakes are impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Sweepstakes are unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Sweepstakes and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
If you use a mobile phone for entry into the Sweepstakes, the telephone calls or text messages you make or send will be charged at the prevailing rates charged by the telecommunication operators of such phone, which may vary from time to time. It is your responsibility to ensure that your entry is received by us before the Sweepstakes closes. Any entries which are not received by us prior to the closure of the Sweepstakes will not be eligible to participate, regardless of the reason for the late entry. The Sponsor is not responsible for any entries which are not received by us, regardless of the cause thereof. Without limitation, the Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer hardware or software failure or malfunction, traffic congestion (whether physical, or on the Internet, telephone lines or at any service provider, web site or other device or medium), or any combination thereof, or any other technical or other problems you experience or that may impair your timely entry into the Sweepstakes. The Sponsor is not responsible for any injury or damage to your or any other person’s computer, mobile telephone or other device used by you to enter into, or obtain any materials related to, the competition. Sponsor will not be responsible for any costs or expenses which you incur during, and for purposes of your entry into, the competition and your acceptance and/or use of a prize. Prizes are not transferable and may not be deferred, changed, or exchanged for cash or any other item. You may not win a prize if it is unlawful for us to supply such a prize to you. If you do win such a prize, you will forfeit it.
- Release and Limitations of Liability
By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, and its parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Sweepstakes, and each of their respective officers, directors, employees, shareholders, representatives, and agents, and Instagram (the “Released Parties“), from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Sweepstakes, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Sweepstakes; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d)any other errors or problems in connection with the Sweepstakes, including, without limitation, errors that may occur in the administration of the Sweepstakes, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, or in any Sweepstakes-related materials; or (e) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. By participating in the Sweepstakes, entrants agree that the Site is in no way affiliated with the Sweepstakes and cannot be held liable for any reason. Entrant hereby grants Sponsor the right to use entrants email address for future emails and/or promotions.
- Disputes
Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located only in State courts in Lake County, Illinois (USA) or in the Federal Court for the Northern District of Illinois (USA), Eastern Division. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Illinois (USA), without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Illinois. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees. Under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
- Privacy
Information collected from entrants is subject to Sponsor’s privacy policy located at Privacy Policy.
- Winner’s List:
For the name of the winners, send a self-addressed stamped envelope within three months after the end of the Sweepstakes Period to Attn: Sovereign Brands Sweepstakes, 383 W. Broadway, 5th Floor, New York, New York 10012. Include the title of the Sweepstakes of which you are requesting the winners list for. Sponsor will not respond to incomplete inquiries or inquiries for a winner list that are received more than three months after the Sweepstakes Period has ended.
